General Terms and Conditions
1. Scope of Application
The following terms and conditions apply to all orders placed through our online shop by consumers and entrepreneurs.
Consumers are any natural persons who enter into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activities. Entrepreneurs are natural or legal persons or partnerships with legal capacity who act in the exercise of their commercial or independent professional activities when concluding a legal transaction.
For entrepreneurs: If the entrepreneur uses opposing or supplementary general terms and conditions, their validity is hereby contradicted; they only become part of the contract if we have expressly agreed to them.
2. Contracting Parties, Conclusion of Contract, Correction Options
The purchase contract is concluded with Klaus Stumpp.
The presentation of products in the online shop does not constitute a legally binding offer, but rather an informal online catalog. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. By clicking the order button, you submit a binding offer for the goods contained in the shopping cart. The confirmation of receipt of your order is sent via email immediately after submitting the order.
We accept your offer within two days by
- sending an acceptance declaration in a separate email or
- delivering the goods or
- if applicable, the payment transaction is carried out by our service provider or the selected payment service provider. The timing of the payment transaction depends on the chosen payment method (see "Payment").
The relevant alternative for you depends on which of the listed events occurs first.
3. Language of the Contract, Storage of the Contract Text
The languages available for the conclusion of the contract are: German, English.
We store the contract text and send you the order data and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the internet.
4. Delivery Conditions
In addition to the indicated product prices, shipping costs may apply. You can find further information on any shipping costs in the offers.
We only deliver via shipping. Unfortunately, self-collection of the goods is not possible.
5. Payment
In our shop, you generally have the following payment methods available:
Advance Payment If you choose the payment method advance payment, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.
PayPal, PayPal Express To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction will be executed by PayPal immediately after placing the order. You will receive further information in the ordering process.
Invoice The invoice amount is due within 7 days after receipt of the invoice and the goods by bank transfer to the bank account specified in the invoice. We reserve the right to offer the purchase on account only after a successful credit check.
6. Right of Withdrawal
Consumers have the statutory right of withdrawal as described in the withdrawal instruction. No voluntary right of withdrawal is granted to entrepreneurs.
7. Retention of Title
The goods remain our property until full payment is received. For entrepreneurs, it additionally applies: We retain ownership of the goods until all claims from an ongoing business relationship have been fully settled. You may resell the goods subject to retention of title in the ordinary course of business; all claims arising from this resale are assigned to us in advance, regardless of whether the goods subject to retention of title have been connected or mixed with a new item, and we accept this assignment. You remain authorized to collect the claims; however, we may also collect claims ourselves if you do not fulfill your payment obligations. The securities to which we are entitled will be released upon your request to the extent that the realizable value of the securities exceeds the value of the open claims by more than 10%.
8. Transport Damages
For consumers: If goods are delivered with obvious transport damages, please complain about such defects as soon as possible to the deliverer and please contact us immediately. The failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, particularly your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.
For entrepreneurs: The risk of accidental loss and accidental deterioration passes to you as soon as we have delivered the goods to the carrier, freight forwarder, or other person or institution designated to carry out the shipment.
9. Warranty and Guarantees
9.1 Liability for Defects Unless expressly agreed otherwise below, the statutory liability for defects applies.
The following limitations and shortening of deadlines do not apply to claims for damages caused by us, our legal representatives, or agents
- in case of injury to life, body, or health
- in case of willful or grossly negligent breach of duty as well as fraud
- in case of violation of essential contractual obligations, the fulfillment of which enables the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)
- in the context of a guarantee promise, if agreed, or
- as far as the scope of the Product Liability Act is opened.
Limitations with respect to Entrepreneurs With respect to entrepreneurs, only our own information and the product descriptions of the manufacturer that have been included in the contract are considered an agreement on the quality of the goods; we assume no liability for public statements by the manufacturer or other advertising statements. For entrepreneurs, the limitation period for claims for defects for newly manufactured goods is one year from the transfer of risk.
The statutory limitation periods for the recourse claim under § 445a BGB remain unaffected.
Regulations with respect to Merchants Among merchants, the inspection and complaint obligation regulated in § 377 HGB applies. If you fail to notify the complaint as regulated there, the goods are deemed approved unless it is a defect that was not recognizable upon inspection. This does not apply if we have fraudulently concealed a defect.
