General Terms and Conditions

1. Scope
The following terms and conditions apply to all orders placed via our online shop by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes which are predominantly not attributable to his commercial or independent professional activity. Entrepreneur is a natural or legal person or a partnership with legal capacity which, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity.

The following applies to entrepreneurs: If the entrepreneur uses opposing or supplementary General Terms and Conditions, their validity is hereby contradicted; they become part of the contract only if we have expressly agreed to this.

2. Contract partner, conclusion of contract, correction possibilities
The purchase contract is concluded with Klaus Stumpp.

The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. You may first place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided for and explained in the order process. By clicking the order button you submit a binding offer for the goods included in the shopping cart. The confirmation of receipt of your order is made by e-mail immediately after sending the order.

We will accept your offer within two days by:

we provide a declaration of acceptance in a separate e-mail or
we have the goods delivered or
where applicable, the payment transaction is executed by our service provider or the selected payment service provider. The execution time of the payment transaction depends on the type of payment selected (see “Payment”).
The relevant alternative for you depends on which of the listed events occurs first.

3. Contract language, contract text storage
Language(s) available for the conclusion of the contract: German, English

We save the contract text and send you the order data and our GTC in text form. The text of the contract is no longer available on the Internet for security reasons.

4. Conditions of delivery
In addition to the stated product prices, shipping costs may be incurred. You can find out more about shipping costs in the offers.

We only deliver by mail. A self-collection of the goods is unfortunately not possible.

5. Payment
The following payment methods are generally available in our shop:

Advance payment
When choosing the payment method Advance payment, we will inform you of our bank details in a separate e-mail and deliver the goods upon receipt of payment.

PayPal, PayPal Express
To transfer the invoice amount via the payment service provider PayPal (Europe) S. à r. l. et Cie, S. C. A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, identify yourself with your credentials and confirm the payment order. The payment transaction is carried out by PayPal immediately after placing the order. You will receive further information during the ordering process.

Invoice
The invoice amount is due 7 days after receipt of the invoice and the goods by transfer to the bank account indicated in the invoice. We reserve the right to offer the purchase on account only after a successful credit check.

6. Right of withdrawal
Consumers are entitled to the statutory right of withdrawal as described in the Cancellation Policy. Entrepreneurs are not granted a voluntary right of withdrawal.

7. Retention of title
The goods remain our property until full payment has been made.
For entrepreneurs the following applies additionally: We reserve the ownership of the goods until all claims from an ongoing business relationship have been paid in full. You may resell the reserved goods in the ordinary course of business; you assign all claims arising from such resale to us in advance in the amount of the invoice amount, regardless of any combination or mixing of the reserved goods with a new item, and we accept this assignment. You remain authorised to collect the receivables, but we may also collect receivables ourselves if you fail to meet your payment obligations. We will release the collateral to which we are entitled at your request to the extent that the realisable value of the collateral exceeds the value of the outstanding receivables by more than 10 %.
